These Terms of Use (“Terms”) govern your access to and use of the ScanHarbor mobile application (the “App”) provided by SS SOFTECH (SMC-PVT) LTD (“we,” “us,” or “our”).
Please read these Terms carefully before using the App. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. About ScanHarbor
ScanHarbor is an iOS document scanner that lets you:
- Scan documents with your camera or import images from your photo library
- Edit, organize, and categorize documents
- Extract text using on-device OCR
- Add signatures
- Export and share PDFs
- Optionally lock the App with Face ID, Touch ID, or device passcode
The App stores your documents locally on your device. We do not provide cloud backup or sync as a core feature of the App.
2. Eligibility
You must be at least the age of majority in your jurisdiction, or have permission from a parent or legal guardian, to use the App. If you use the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms and the Usage Rules in the Apple App Store Terms of Service.
You may not:
- Copy, modify, or create derivative works of the App except as allowed by law
- Reverse engineer, decompile, or disassemble the App except as allowed by law
- Rent, lease, lend, sell, sublicense, or distribute the App
- Remove proprietary notices or labels
- Use the App for unlawful, harmful, or abusive purposes
- Interfere with or disrupt the App or its servers or networks
- Use automated means to access the App in a manner that burdens our systems or third-party services
All rights not expressly granted are reserved.
4. Apple App Store Terms
The App is made available through the Apple App Store. In addition to these Terms:
- Apple is not a party to these Terms and is not responsible for the App or its content.
- Your use of the App must comply with the Apple Media Services Terms and applicable App Store policies.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
For in-app purchases, billing, refunds, and subscription management (if applicable in the future), Apple’s payment terms apply.
5. Your Content and Responsibilities
5.1 Your documents
You retain ownership of documents, images, text, signatures, and other content you create or import in the App (“User Content”).
You are solely responsible for:
- The content you scan, import, store, export, or share
- Ensuring you have the right to scan, store, and use that content
- Complying with laws that apply to your documents (including privacy, employment, health, financial, and intellectual property laws)
- Backing up important data
We do not monitor User Content stored on your device.
5.2 No professional advice
ScanHarbor is a productivity tool. OCR results may contain errors. The App does not provide legal, tax, medical, or other professional advice. Verify important information before relying on it.
5.3 Sharing and export
When you export or share documents through iOS features, you choose the destination and recipients. We are not responsible for what happens to your content after you share it.
6. In-App Purchases
6.1 Remove Ads
The App may offer a non-consumable in-app purchase to remove advertisements (“Remove Ads”). Product details, price, and localized descriptions are shown in the App and on the App Store.
- Payment is processed by Apple.
- Purchases are tied to your Apple ID and may be restored on devices signed in with the same Apple ID, using Restore Purchases where available.
- Remove Ads applies to ad placements within the App as implemented at the time of purchase. It does not remove ads on third-party websites or services you access outside the App.
6.2 Refunds
Refund requests for in-app purchases are handled by Apple according to Apple’s policies. We cannot issue refunds for Apple-processed payments.
7. Advertising
If you have not purchased Remove Ads, the App may display advertisements served by Google AdMob, including banner, interstitial, rewarded, and/or app-open formats.
- Ads may be personalized based on your device settings, consent choices, and applicable law.
- In some regions, you will be asked for advertising consent through Google’s User Messaging Platform (UMP).
- You can manage ad privacy choices in the App (Settings → Ad Privacy Choices, when available) and in iOS privacy settings.
Rewarded ads may offer optional benefits (for example, unlocking a high-quality export). Watching rewarded ads is voluntary.
We are not responsible for the content of third-party advertisements or websites they link to.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and share information. By using the App, you consent to our privacy practices as described there.
9. App Permissions and Device Features
The App may request access to camera, photo library, biometrics, and tracking-related permissions. Features depend on your device and the permissions you grant. You can change permissions in iOS Settings.
Biometric unlock uses Apple’s authentication APIs. We do not receive or store your biometric data.
10. Updates and Changes
We may update the App to add features, fix bugs, improve security, or comply with legal or platform requirements. Updates may be required for continued use.
We may modify these Terms at any time. If we make material changes, we will post the updated Terms with a new “Last updated” date and, where appropriate, provide notice in the App. Your continued use after changes become effective constitutes acceptance of the revised Terms.
11. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- OCR RESULTS OR PDF OUTPUT WILL BE ACCURATE OR COMPLETE
- DATA STORED ON YOUR DEVICE WILL NEVER BE LOST (YOU SHOULD MAINTAIN BACKUPS)
- ADS WILL ALWAYS BE AVAILABLE OR FREE OF THIRD-PARTY CONTENT YOU FIND OBJECTIONABLE
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE APP.
- OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP OR IN-APP PURCHASES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $50.
These limitations apply even if we have been advised of the possibility of such damages and regardless of the theory of liability.
Some jurisdictions do not allow limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the App
- Your User Content
- Your violation of these Terms
- Your violation of any law or third-party rights
14. Termination
You may stop using the App at any time by uninstalling it.
We may suspend or terminate your access to the App if we reasonably believe you violated these Terms or applicable law, or if necessary to protect users, third parties, or the App.
Upon termination, the license granted to you ends. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) will survive.
Deleting the App may delete locally stored documents unless you have exported backups elsewhere.
15. Export and Sanctions
You may not use or export the App except as authorized by applicable law and regulations. You represent that you are not located in a country subject to comprehensive embargo or sanctions and are not listed on any government restricted-party list.
16. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which the SS SOFTECH (SMC-PVT) LTD is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.
Any dispute arising from these Terms or the App will be resolved in the courts of that jurisdiction, unless applicable law requires a different forum. Nothing in these Terms limits rights you may have as a consumer under mandatory local law.
These Terms are intended for publication by SS SOFTECH (SMC-PVT) LTD. For final legal accuracy, have a qualified attorney review the governing law and venue for your business jurisdiction.
17. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented for specific features or purchases, constitute the entire agreement between you and us regarding the App and supersede prior agreements on that subject.
